Terms of Use

These Terms of Use govern your use of the Namarc POS public website — the pages you can browse without signing in, such as the home page, this page, and our other legal pages. They do not cover use of the Namarc POS dashboard once you have created a shop; that is governed by our Terms & Conditions, and how we handle your personal data is covered by our Privacy Notice.

1. Introduction & acceptance

This website is operated by Namarc Technology (“Namarc”, “we”, “us”, “our”) to describe Namarc POS, a point-of-sale and shop management application, and to let visitors create a shop account, sign in, or get in touch. By browsing this website or submitting the contact form, you agree to these Terms of Use. If you do not agree, please do not continue using the website.

2. Definitions

“Website” means the public Namarc POS pages reachable from our home page, including this page. “Service” means the Namarc POS application itself — the dashboard you reach after creating a shop and signing in. “You” means anyone browsing the Website, whether or not you go on to create a Service account.

3. Using this website

You may browse the Website, use the “Create your shop” and “Log in” links to reach the Service, and submit the contact form to reach our team. We ask that you provide accurate information when you use the contact form, and that you do not use it to send spam, unsolicited advertising, or anything unlawful — see Acceptable use below.

4. Intellectual property

The Website — including its text, layout, graphics, and the Namarc POS name and logo — is owned by Namarc Technology or its licensors and is protected by intellectual property law. You may view and print pages of the Website for your own personal or business use in deciding whether to sign up for the Service, but you may not otherwise copy, reproduce, republish, or create derivative works from the Website without our written permission.

5. Acceptable use

You agree not to, in connection with the Website:

• attempt to gain unauthorized access to the Website, the Service, or any account that is not yours;
• interfere with or disrupt the Website's operation, for example by overloading it with automated requests;
• use the contact form to send spam, unsolicited marketing, or unlawful, threatening, or fraudulent content;
• scrape, harvest, or otherwise systematically extract content from the Website for a competing product; or
• misrepresent your identity or affiliation when contacting us.

6. Third-party links

The Website may occasionally link to third-party sites (for example a mapping or payment provider). We do not control and are not responsible for the content or practices of sites we do not operate, including our sister product's website at events.namarc.co.tz.

7. Accounts created through this site

When you use “Create your shop” you are taken into the Service to create an account, which is then governed by our Terms & Conditions rather than these Terms of Use. Creating an account is free and does not require a credit card; a subscription plan and any related billing only apply once you choose to start one from inside the Service.

8. Disclaimers

The Website is provided “as is”. While we try to keep the information on it accurate and the site available, we do not guarantee that the Website will be error-free, uninterrupted, or free of occasional downtime for maintenance or updates.

9. Limitation of liability

To the maximum extent permitted by law, Namarc Technology is not liable for indirect, incidental, or consequential damages arising from your use of the Website. Nothing in this section limits liability that cannot lawfully be limited.

10. Changes to these terms

We may update these Terms of Use from time to time to reflect changes to the Website. The “Last updated” date at the top of this page shows when that last happened. Continuing to use the Website after a change takes effect means you accept the updated terms.

11. Governing law

These Terms of Use are governed by the laws of the United Republic of Tanzania, and any dispute arising from them is subject to the exclusive jurisdiction of the courts of Tanzania.
