These Terms & Conditions (“Terms”) govern access to and use of the Namarc POS dashboard — the service you reach after creating a shop and signing in. They apply from the moment you create an account. Our Terms of Use separately cover browsing our public website, and our Privacy Notice covers how we handle your personal data.
1. Introduction & acceptance
Namarc POS (“the Service”) is operated by Namarc Technology (“Namarc”, “we”, “us”, “our”). By creating a shop account or otherwise using the Service, you (“Client”, “you”) agree to be bound by these Terms. If you are registering on behalf of a business, you confirm you have the authority to bind that business, and “you” then refers to that business.
2. Definitions
- Account — the shop-owner profile created when you register, together with any staff (“sub-user”) accounts created under it.
- Shop (also called a business center) — a single business location managed inside your Account, with its own products, stock, sales, and staff assignments.
- Service — the Namarc POS dashboard and all features it exposes, including sales & receipts, stock & expiry tracking, staff roles, expense tracking, and reporting.
- Subscription Plan — the tier of the Service you or your account has selected, which determines limits such as the number of shops and staff accounts you can create.
3. Eligibility & account registration
You must be able to enter into a binding contract to register an Account. Registration asks for your name, email address, and phone number, and creates your first shop automatically so you can start using the Service right away — see our Privacy Notice for the full list of what we collect. You are responsible for keeping your login credentials confidential and for activity under your Account, including activity by staff accounts you create. If you suspect unauthorized use of your Account, let us know promptly at info@namarc.co.tz.
4. Services we provide
Namarc POS lets you record sales and print or share receipts, manage product stock in batches with expiry-date tracking, run more than one shop from a single Account (subject to your plan's shop limit), add staff with role-based permissions controlling what each person can see and do, track business expenses alongside sales, and generate sales, stock, and profit & loss reports. Available features can vary by your Subscription Plan. We may add, change, or remove features over time; where a change materially reduces functionality you actively rely on, we will make reasonable efforts to let you know beforehand.
5. Acceptable use
You agree not to use the Service to:
- record or process transactions you know to be fraudulent, or to launder the proceeds of unlawful activity;
- attempt to access another Account, shop, or staff login you are not authorized to use;
- reverse-engineer, resell, or white-label the Service without our written agreement;
- upload content (product names, descriptions, receipts) that is unlawful, defamatory, or infringes another party's rights; or
- attempt to circumvent the limits (shops, staff accounts, features) attached to your Subscription Plan.
We may suspend an Account or a specific feature where we reasonably believe it is being used in violation of this policy.
6. Data you enter into the Service
Content you enter into the Service — product catalogs, stock records, sales and receipts, expense entries, and staff assignments — remains yours. You are responsible for its accuracy, including any customer name recorded on a sale, and for having any rights or consents needed to enter it. You can export or delete this content by contacting us, subject to records we are legally required to retain (see our Privacy Notice's Data retention section).
7. Multiple shops & staff accounts
Owner Accounts can run more than one shop and create staff (sub-user) accounts, both subject to the limits of your Subscription Plan, shown on your account's Subscription screen. A staff account only has access to what its assigned role permits; the shop owner is responsible for the roles and access they grant to their staff.
8. Subscription, trial & billing
Creating a shop is free and does not require payment details. The first time you select a Subscription Plan, a free trial period (currently one month) begins before any payment is due; the length of any trial will be shown to you before it starts and may change over time. Once a trial ends, continued use of a paid plan is billed according to the price and billing cycle (monthly or annual) shown on your account's Subscription screen at the time. Payment is currently confirmed manually — for example by sending payment to the M-Pesa number shown in your account and having our team confirm it — rather than through an automated in-app payment gateway; this may change as the Service evolves. Fees already billed are non-refundable except where required by law. We may limit access to paid features on an Account with an unpaid balance until payment is confirmed.
9. Availability & support
We aim to keep the Service available at all times but do not guarantee uninterrupted access; we may carry out scheduled or emergency maintenance that temporarily affects availability. Support requests can be sent to the contact details below.
10. Intellectual property
The Service, including its software, design, and the Namarc POS name and logo, is owned by Namarc Technology and protected by intellectual property law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service for your own business; they do not transfer ownership of the Service to you.
11. Confidentiality
Each party agrees to protect the other's confidential information shared in connection with the Service and to use it only for purposes of the relationship between us, with at least the same care each party uses to protect its own confidential information.
12. Limitation of liability
To the maximum extent permitted by law, Namarc Technology is not liable for indirect, incidental, special, or consequential damages, or for lost profits or lost data, arising from your use of the Service. Our total liability for any claim arising from these Terms is limited to the fees you paid for the Service in the three months preceding the claim.
13. Indemnification
You agree to indemnify and hold Namarc Technology harmless from any claim, loss, or expense (including reasonable legal fees) arising from your use of the Service in violation of these Terms, applicable law, or the rights of a third party.
14. Suspension & termination
You may stop using the Service at any time. We may suspend or terminate an Account, with or without notice, if it breaches these Terms, if required by law, or where we reasonably believe suspension is necessary to protect the Service or other users. Provisions that by their nature should survive termination — including billing for services already delivered, confidentiality, and limitation of liability — will survive.
15. Governing law & disputes
These Terms are governed by the laws of the United Republic of Tanzania. Any dispute arising from these Terms or the Service will first be addressed through good-faith negotiation between the parties and, failing resolution, will be subject to the exclusive jurisdiction of the courts of Tanzania.
16. Changes to these terms
We may update these Terms from time to time. Where a change is material, we will provide reasonable notice (for example by email or an in-dashboard notice) before it takes effect. Continued use of the Service after a change takes effect means you accept the updated Terms.
